1. Eligibility

The Services are not intended for individuals under the age of 18 or below the minimum age of digital consent, as applicable. By accessing or using the Services, you affirm and agree that:

  • (i) you are 18 years of age or older, or you have reached the minimum age of digital consent in your country;
  • (ii) if you are of legal age or above the age of majority in your jurisdiction, you have read, understood, and accepted these Terms; and
  • (iii) if you are between the ages of 18 (or the minimum age of digital consent, as applicable) and the age of majority in your jurisdiction, your legal guardian has reviewed and agreed to these Terms. If we become aware of the Services being used by a child under the age of 18 or the minimum age of digital consent, we reserve the right to terminate their access to the website and the services.

2. Privacy

Our Privacy Policy is an integral part of these terms and conditions. For detailed information on the collection, use, and sharing of user information through our Services, please refer to our Privacy Policy.

3. Your Account

You are responsible for the security and integrity of your login credentials, any information provided by you, and any actions taken using your Account within the Services. Registering multiple Accounts on the Services, whether in your name or not, is prohibited. By registering, you confirm that the information provided to us is truthful, accurate, up-to-date, and complete. We reserve the right to reject any username or to terminate or prevent the use of a username at our discretion. Safeguarding the confidentiality of your login credentials is your responsibility, and you are liable for all activities carried out using your credentials or Account. If you suspect any unauthorized use of your Account or a breach of your login credentials' confidentiality, you agree to promptly notify 4Traders. We will not be held liable for any losses or damages arising from unauthorized use of your credentials.

4. Fair Reward Selection Process

Intent and Fairness:

Our selection process for rewarding club members is designed with the primary intent of ensuring fairness and preventing any resemblance to a lottery or raffle draw. Our aim is to reward as many people as possible with the best rewards available.

Selection Criteria:

The selection of members to receive rewards is based on their earned loyalty points, which they accumulate through their membership and engagement with our website, discord and trading community. The loyalty points are considered by a Large Language Model such as ChatGPT which is given a prompt containing each members name and their corresponding loyalty points, the LLM then selects the member who will recieve the reward.

Rewardees may also be selected by content creators on their live broadcasts.

Non-Discrimination:

We are committed to a non-discriminatory approach. No member of the family or an associate of an employee shall receive any unfair advantage in the reward selection process.

Weighted Selection:

The reward selection process revolves around the loyalty points a club member has accumulated. Members with more loyalty points have a greater rewardability.

Exclusive Reward Categories:

From time to time, we may offer exclusive rewards to members within specific loyalty point ranges. These exclusive reward categories will be clearly communicated to members, and the selection process for these rewards will be based on the loyalty points within those specific ranges.

Right to Modify:

We reserve the right to modify the Fair Reward Selection Process, including changes to how loyalty points function and the introduction of new exclusive reward categories. Any modifications will be communicated to members in advance, providing transparency in the selection process.

Compliance with Laws:

Our Fair Reward Selection Process adheres to all relevant laws and regulations, ensuring that it does not constitute a: sweepstake, drawing, chance game, lucky draw, game of chance, gambling event, game of luck, random prize allocation, hazard game, draw of lots, prize draw, chance-based competition. The final decision is authorized by ChatGPT via a prompt conducted by a non-employee or by a content creator at the time of a live broadcast.

5. Cancellation Policy:

  • (a.) Subscribers can follow the instructions provided in the confirmation email to manage their subscription directly themselves on the profile page.
  • (b.) How to Cancel Via PayPal: Subscribers can cancel their subscription in their PayPal recurring payments settings.
  • (c.) How to Cancel Via Stripe: Subscribers can cancel their subscription in their Stripe customer dashboard.
  • (d.) How to Cancel Crimson Market Monthly Subscription:
    1. Login to your account on The Crimson Market website.
    2. Click on your profile name.
    3. Click on Account Settings.
    4. Click on Manage Subscription.
    5. Click Cancel Subscription on the subscription you wish to cancel.

6. Refund Policy:

Subscription Refunds:

TCM has a 100% refund policy for requests made within 7 days of the last payment as long as the payment was not made before the last large reward. The Crimson Market has an automatic refund system that allows subscribers to trigger refunds directly and hassle free.

  • (a.) Refund Period: Subscribers must issue a refund within 7 days of their last payment and the Last Large Reward must have been announced before that payment.

Refund Discretion:

Refunds Beyond 7-Day Notice: Refunds requested beyond the 7-day notice period are at our discretion and are technically impossible as the loyalty points have been used or counted.
Credit Card Security: TCM does not store any credit card information or data, all data is stored within PayPal or Stripe. Our refund policy is designed to ensure credit card security and compliance with Payment Card Industry Data Security Standard (PCIDSS).

No Reward Selection Policy:

Subscribers are advised that subscription fees are primarily intended to support the development of The Crimson Market, creation of tools to support our community and the sponsorship of content creators.

7. Eligibility for Reward Policy:

Paid Subscription Period:

To be eligible for a reward, an individual must have an active paid subscription period with 4Traders Pty Ltd. Rewards will be awarded within the subscription paid period.

Cancellation Does Not Terminate Paid Period:

Canceling a subscription does not terminate the ongoing paid period. Subscribers who have paid for their subscription and have an active period at the time of the reward selection will still be eligible to receive rewards.

Open Rewards:

Rewards may be open to all subscribers, regardless of payment status or subscription cancellation. These specific rewards will be announced and made accessible to all eligible members.

Failed Payment Honoring:

In the event that a subscriber's payment fails during the reward selection process, we understand that unforeseen issues may arise. As such, we will honor the eligibility of the subscriber if the payment is made within 5 days of the failed transaction. However, the final decision regarding eligibility will rest with the company's directors.

Director's Discretion:

The ultimate decision regarding a subscriber's eligibility for a reward, even in cases of failed payments, rests with the company's directors. Their judgment on eligibility is final.

Unclaimed Rewards:

If a selected member is unable to accept a reward for any reason, it is at the discretion of the directors to choose an alternative candidate. This decision will be made in the best interests of the company and its subscribers.

Abandoned Rewards:

A reward will be considered abandoned if the selected member cannot be contacted within 2 weeks of the reward announcement. In such cases, the directors will determine whether to reassign the reward to another eligible member.

We remain steadfast in our responsibility to safeguard and enforce our trademark rights, reinforcing our position as a trusted leader in the industry. 9. Legal Jurisdiction and Applicable Laws:

4Traders Pty Ltd (ABN: 82 670 487 813) operates under the following jurisdiction and applicable laws:
Legal Jurisdiction: All legal matters, disputes, and issues related to 4Traders Pty Ltd shall be subject to the legal jurisdiction of Victoria, Australia. Any legal action, arbitration, or resolution shall be conducted in accordance with the laws of the state of Victoria.
Applicable Laws: The company, 4Traders Pty Ltd, is bound by and shall operate in compliance with all relevant and applicable federal and state laws of Australia, as well as any industry-specific regulations that pertain to its business operations.
